Understanding and mitigating the impact of family dynamics on estate litigation, such as those which can arise in blended families, with second marriages and in other family relationships is key to an effective estates practice. Understanding, anticipating and mitigating these reactions is crucial for all parties involved, whether they are the testator, executor, beneficiary, or plaintiff/claimant.

In Canada, nearly 12% of families with children are blended, where some or all of the children are from previous relationships, and over 25% of marriages are second marriages. This session will explore the common challenges estate litigators face when dealing with family members and claimants who are motivated by the dynamics that can arise in these scenarios. The presenters will discuss proactive measures to avoid or minimize the risk of litigation and offer insights into resolving conflicts effectively.
